ORDERING PRODUCTS AND CONSUMER PROTECTION

Orders placed through the luxe-yachting.com e-shop constitute distance selling contracts, which are governed by the legal framework of Law 2251/1994 (as currently in force) and the amendments referred to in Decree 131/2003 (Government Gazette A’ 116/16.05.2003) and Resolution 31619, Government Gazette 969/22.3. 2017 and the adaptation of Greek legislation to Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council, which was published in the Official Journal of the European Union, No. L 304 of 22.11.2011, as it entered into force on 13/06/20

The user has the right to conclude a valid order through the e-shop, provided that he/she is legally competent to act in accordance with the provisions of the Greek Civil Code (provided that he/she has reached the age of eighteen and is not subject to legal representation for the conclusion of a sales contract). Orders may also be placed by legal representatives of legal entities. Our company reserves the right to claim the return from the supervisor or guardian of any orders placed by legally incompetent persons.

RETURNS / CHANGES / CANCELLATIONS

Returns policy

The terms and conditions described in this policy apply to all products purchased in Greece through the luxe-yachting.com online store.

Cancellation of order

When you place your order through the luxe yachting, you have the option to cancel your order within the same day you placed the order.

For any return of your products you can send us your request in writing by e-mail to info@luxe-yachting.com or reach out directly. For any information you need, you can contact us by consulting the contact details on our site. The products you wish to return must be in perfect condition. You are responsible for the cost of returning the products unless the product falls under warranty issues due to a manufacturing defect. Should you use the product you must ensure that you return it in perfect condition, together with all parts and components of which it is made up.

You agree to take care of the condition of the returned products from the moment they are delivered to you until the moment you deliver them to our store or to the carrier or courier company.

Our company is not responsible for defects or poor quality of the products made available to its customers. In the event that a defective product is found in the delivered products, you reserve the right to return and replace it at our shipping costs.

In the event that they are not returned within 15 days then our company may not accept any return or replacement product. In any case, the maximum return for replacement may not be extended beyond fifteen (15) calendar days from the date of receipt.

In addition to the rights provided by the laws and regulations relating to the sales contract, all rights applicable to consumers under existing provisions and laws relating to the sales contract, as well as any rights arising in connection with the warranty conditions of the products, shall apply in any case.

Transport of returned products

If you wish to return goods due to a change of mind, you will be charged the direct cost of returning the goods. Returned goods can only be collected from the address that you have indicated to us in writing and which you have indicated to us in writing.

You agree to provide our company with as much detail as possible about the address for the collection of the goods, for example floor, difficulties of access for the carrier/courier, existence of lifts, narrow stairs, etc., in order to facilitate the collection process from the location you indicate to us. You agree that there will be adequate access to the site for the collection of the returned goods.

If the carrier/courier believes that picking up the goods from the area you indicate may cause damage to your property, they will inform you verbally and record this on the pick-up form. You may instruct the partner transport company/courier to collect the goods despite this instruction, however we will not be liable for any damage that may be caused to your property or the goods as the collection of the goods will be carried out with due care and attention.

You agree to give the partner all the goods you wish to return, including all parts and accessories that make up the goods. Upon receipt of the returned products by the carrier, you will sign a receipt form to certify that delivery to the carrier has taken place. The receipt form will be given to you by the partner carrier/courier.

If you are unable to be present yourself when the goods are collected from the site, you can appoint a representative to undertake this process on your behalf. This representative must be an adult and capable of supervising the collection of your goods in your place.

Reimbursement of the value of returned products

If you qualify for a refund, we will refund you the amount corresponding to the value of the goods you are returning in the same way as you made the original transaction unless you wish another method of return, in which case you must inform us in writing.

A refund of the value of the returned goods will be made as soon as possible. In any event, it will be carried out after you have informed us in writing of your request for the return of the goods and we accept the return and once the goods have been delivered to the partner carrier/courier.

Exceptions to the right of withdrawal

The right of withdrawal does not apply in the following cases:

  • the supply of goods that are manufactured according to the specifications that you as the consumer have set or clearly personalised (Private label products)
  • the supply of goods which, after delivery, by their very nature, are inseparably mixed with other items

MISCELLANEOUS

  • Force majeure: If for reasons of force majeure (e.g. bad weather conditions, strikes, etc.) it is not possible to deliver the products within the predetermined time, we will inform you by phone or e-mail, in order to let us know if you wish, under these circumstances, to complete your order. Our company accepts no responsibility for any situation that is beyond its control and will do everything humanly possible for your best service.
  • In cases where you have placed an online order and upon receipt you find that one or more products are missing from the total order, please contact us so that we can arrange all the details required and send you the products you did not receive at no extra charge.
  • Modification of the terms and conditions herein: Our company reserves the right to modify or renew the terms and conditions of transactions. We reserve the right to amend or modify the terms and conditions of sale and purchase, and undertake to update this document with any changes or additions to the terms and conditions.
  • In the event of non-receipt of the goods ordered (and if a long period of time has elapsed since the order was placed), please contact our company. For the best and fastest service, we recommend that you quote the special order code sent to the e-mail address you provided when placing your order.

In accordance with Directive 2013/11/EC, which was incorporated into Greek legislation by KYA 70330/2015 and Decision 31619 Government Gazette 969/22.3.2017 (article 8), the possibility of electronic resolution of consumer disputes through the Alternative Dispute Resolution procedure is provided for throughout the European Union.
